It also describes your choices and rights concerning yourPersonal Data, including your rights of access and correction of your PersonalData. Customers may collect and managePersonal Data when using the Subscription Service. Data4Salesn processes suchdata as a processor under the direction of our customers. Our customers, asdata controllers, are responsible for complying with any regulations or lawsthat require providing notice, disclosure, and/or obtaining consent before collectingtheir customers' Personal Data using the Subscription Service. Please see the"Information We Collect and Process When You Use the SubscriptionService" section and our Customer Data Processing Agreement.

We update this Privacy Policy fromtime to time, and we encourage you to review this Privacy Policy periodically.We will post any Privacy Policy changes on this page. If the changes arematerial, we will provide more prominent notice by sending you an e-mailnotification, or if you subscribe to our products and services, through theNotification app in your Data4Sales account. Terms not otherwise defined inthis Privacy Policy will have the meaning as outlined in the Data4SalesCustomer Terms of Service. For this Privacy Policy, "Personal Data"shall mean any information relating to an identified or identifiableindividual. Such information is protected similarly to personal data orpersonally recognizable information under applicable Data Protection Laws (asdefined in the Data4Sales Data Processing Agreement).

1. What Information We Collect About You

a. Information You Provide toData4Sales

When you interact with us via ourwebsites or use the Subscription Service, we may collect Personal Data andother Information from you, as further described below.

When You Visit our Websites

We collect Personal Data from you whenyou submit web forms or interact with our websites, for example, subscribing toData4Sales blog, signing up for a webinar, or requesting customer support. Wemay ask for your e-mail address, first and last name, job title, and similarbusiness information. You are free to explore some of our websites withoutproviding any Personal Data about yourself.

INBOUND and Other Event Information

When you register for INBOUND orData4Sales event, we collect information such as name, address, phone number,and e-mail address. We use this information to communicate with you and, insome cases, facilitate your registration. Additionally, we may share yourregistration data with INBOUND service providers to provide event informationand improve your experience at INBOUND or future Data4Sales events.

Account and User Information

We collect Personal Data when yousign-up for an Data4Sales account, create or modify user information, setpreferences, or provide any other related information to access or utilize ourSubscription Service.

Payment Information

We collect payment and billinginformation when you register for paid products or services. For example, wemay ask you to provide a billing address, or a billing contact for yourData4Sales account. If you give us payment information, we use it solely as authorizedby you in accordance with this Privacy Policy.

You may also provide paymentinformation when purchasing products or services, such as a credit card numberor bank account number. We use secure third-party payment service providers tomanage payment processing, which is collected through a secure payment process.

Customer Testimonials

We post customer testimonials andcomments on our websites, which may contain Personal Data. We obtain eachcustomer's consent via e-mail or through other agreements between customers andData4Sales prior to posting the customer's name and testimonial.

b. Information We Collect and ProcessWhen You Use the Subscription Service

Log Files

When you visit our websites or use theSubscription Service, we automatically collect information about your computerhardware and software. This information can include your IP address, browsertype, domain names, internet service provider (ISP), the files viewed on oursite (e.g., HTML pages, graphics, etc.), operating system, clickstream data,access times, and referring website addresses.

Usage Data

We collect usage data when you or yourusers in your Data4Sales account interact with the Subscription Service. Weengage third-party providers to collect usage data, and we only share data withthese providers in an unidentified manner. Usage data includes metrics andinformation regarding your use and interaction with the Subscription Service,such as what product features you use the most, when an object (like a ticket)is opened and closed, and how often particular features (like workflows) aretriggered in your account.

Mobile

When you access or use theSubscription Service via our mobile applications, we automatically collectinformation such as your device model and version, operating system, or deviceidentifier.

Third Party Integrations

You may connect third partyintegrations to your Data4Sales account, which may ask for certain permissionsto access data or send information to your Data4Sales account. It is yourresponsibility to review any third party integrations you authorize.

Any permission(s) granted by you,grants these third parties access to your data, which may include (but is notlimited to) granting third-party applications access to view, store, and modifyyour Data4Sales account data. We are not responsible for the practices of thirdparty integrations, so please carefully review the permissions you grant tothird-party applications.

If you use the Gmail integration orchoose to integrate any other G Suite application with Data4Sales, you will beasked to give us access to information from your Gmail or Google account. Youcan learn more about how we access this data here or via in-app notice when youconnect to Gmail.  

Google Drive Integration

As part of connecting your GoogleDrive, the Subscription Service will be able to: see your files, upload anddownload your files, and store file contents and titles.

Google Search Console

You can integrate your Google SearchConsole with our Content Management System (CMS). As part of this integration,the Subscription Service will be able to: manage the list of sites and domainsyou control, view and manage the list of sites and domains you control, viewand manage the owners of domains you control.

Data4Sales Partners

We may receive information about youor other users of your Data4Sales account from our global network of partners.We may receive this data from our deal and/or lead registration process throughour partners or through our partner co-marketing agreements.

Third Parties

We may receive information from thirdparty service providers, from related companies, and from our business andsolution partners.

Other Data4Sales Companies

We may receive information about youfrom other companies that are owned or operated by Data4Sales, in accordancewith their terms and policies located here.

c. Information We Process on Behalf of Customers

Our online Subscription Service allowsour customers to create and share marketing, sales and customer service content.When customers use the Subscription Service, they may collect Personal Datasuch as first and last name, e-mail address, physical address, phone number, orother information about you. We do not control the content of our customers'webpages or the types of Personal Data that our customers may choose to collector manage using the Subscription Service. We store our customers' informationon our service providers' servers but process it as a processor under ourcustomers' instructions and in accordance with our Customer Terms of Service,which prohibit us from using the information except as necessary to provide andimprove the Subscription Service and as required by law.

Our customers control and areresponsible for correcting, deleting or updating the information they processusing the Subscription Service and for complying with any regulations or lawsthat require providing notice, disclosure, and/or obtaining consent prior totransferring the Personal Data to Data4Sales for processing purposes.

2. How We Use Your Information

a. To Provide the Product and Services

To Market and Promote the SubscriptionService

We use the information you provide toData4Sales to market and promote the products, services, and other offerings.For example, we use the information, like your e-mail or physical address, tosend Information or Data4Sales content to you which we think may be of interestto you by post, e-mail, or other means and send you marketing communicationsrelating to our business. We use this information to promote the use of ourservices to you and share promotional and information content with you inaccordance with your communication preferences.

We may also reach out to you viatelephone to ask about other Data4Sales products or services you may beinterested in. If you have a call scheduled with an Data4Sales representative,we may record and transcribe the call. You will be notified prior to the callthat the call is being recorded, and you will be offered an opportunity toopt-out of having the call recorded.

To Communicate with you about theServices

We use the data you provide toData4Sales when signing up for the Subscription Service to contact you viae-mail or in-app notification about billing, account management, and otheradministrative matters. We send updates to you regarding our Customer Terms ofService or other legal agreements. We may also communicate with you aboutsecurity incidents via e-mail or in-app notification.

We use your information to providecustomer support, such as resolving technical issues you encounter andanalyzing product outages or bugs.

To Provide and Improve theSubscription Service

We use your account information andCustomer Data to provide the product and services to you. For example, we usethe e-mail address you provide when signing up for the product to create youruser account, and we use your payment information to process payments for paiduse of the Subscription Service.

We collect data about how our productsand services are used by monitoring and tracking our product users. We use thisdata to develop and improve our products and services. For example, we useusage data to assess trends and usage across the product to help us determinewhat new features or integrations our users may be interested in. We may shareusage data externally but will only do so in an anonymized and/or aggregatedmanner to build and improve product features.

We use Customer Data in an anonymizedmanner for machine learning that supports certain product features andfunctionality with the Subscription Service. For example, machine learninghelps customer segmentation data models and allows for easier imports of datainto your Data4Salesaccount. You may opt-out of having your Customer Data usedfor machine learning purposes by e-mailing support@data4sales.com

To Secure and Protect our Product andData4Sales Users

We use your account information toinvestigate and help prevent security incidents. We may also use thisinformation to meet legal requirements. We use your information to verify useraccounts and new product sign-ups, and to detect and prevent product abuse.This includes enforcing our Acceptable Use Policy.

For Research and Development

We may share externally or provideother companies with statistical information about our users, but thisinformation will not be used to identify any individual user and will only beshared on an aggregate and de-identified basis. For example, we may publishblog posts on trends or insights into how users are interacting with theproduct.

Mobile

If you use the mobile applications, wemay send you push notifications from time to time in order to update you aboutevents and promotions. If you no longer wish to receive such communications,you may turn them off at the device level.

Log Files

Log files are used by Data4Sales toprovide general statistics regarding use of the websites. For these purposes,we do link this automatically-collected data to other personal data such asname, e-mail address, address, and phone number. We also use log files totroubleshoot and investigate security incidents.

Third Parties

We receive information from thirdparty service providers. We may receive and use this information from theseservice providers in combination with other information we collect throughother means described in this Privacy Policy for the purposes of providing youwith updates and an improved Subscription Service, like personalizedcommunications, event promotion, and tailoring the websites or product toimprove user experience.

Social Media Features

Our websites include social mediafeatures, such as the Facebook 'like' button and widgets, such as the sharebutton or interactive mini-programs that run on our websites. These featuresmay collect your IP address, which page you are visiting on our sites, and mayset a cookie to enable the feature to function properly. Social media featuresand widgets are either hosted by a third party or hosted directly on ourwebsites. This Privacy Policy does not apply to these features. Yourinteractions with these features are governed by the privacy policy and otherpolicies of the companies providing them.

Public Forums

We offer publicly accessible messageboards, blogs, and community forums. Please keep in mind that if you directlydisclose any information through our public message boards, blogs, or forums,this information may be collected and used by others. We will correct or deleteany information you have posted on the websites if you so request, as describedin the section "To Unsubscribe From Our Communications" below.

3. How we Share information we Collect

a. Third Parties and Service Providers

We employ other third-parties andservice providers to provide services on our behalf to our website visitors,our customers, and users of the product and services. We may need to share yourinformation with service providers to provide information about products orservices to you. Examples may include removing repetitive information fromprospect lists, analyzing data or performing statistical analysis on your useof the Subscription Service or interactions on our websites, providingmarketing assistance, processing credit card payments, supplementing theinformation you provide us in order to provide you with better service,developing and improving the product and services, and providing customerservice or support. These service providers are prohibited from using yourPersonal Data except for these purposes, and they are required to maintain theconfidentiality of your information. In all cases where we share yourinformation with such agents, we explicitly require the agent to acknowledgeand adhere to our privacy and data protection policies and standards.

b. Partners

We may share data with trustedData4Sales partners to contact you based on your request to receive suchcommunications, help us perform statistical analysis, or provide sales support,or provide customer support. Partners are prohibited from using your PersonalData except for these purposes, and they are required to maintain theconfidentiality of your data.

We partner with trusted third partiesto provide you with co-marketing content that we think may be relevant to you.When you engage with these co-marketing partners, we will tell you who we aresharing data with, and provide a link to the co-marketing partner's privacypolicy so you can learn more about how to opt-out of the partner'scommunications. These co-marketing partners are required to adhere to ourprivacy and data protection policies.

c. Corporate Events

If we (or our assets) are acquired byanother company, whether by merger, acquisition, bankruptcy or otherwise, thatcompany would receive all information gathered by Data4Sales on the websitesand the Subscription Service. In this event, you will be notified via e-mailand/or a prominent notice on our website, of any change in ownership, uses ofyour Personal Data, and choices you may have regarding your Personal Data.

d. Compelled Disclosure

We reserve the right to use ordisclose your Personal Data if required by law or if we reasonably believe thatuse or disclosure is necessary to protect our rights, protect your safety orthe safety of others, investigate fraud, or comply with a law, court order, orlegal process. If you use the Subscription Service, Customer Data is consideredConfidential Information and you should review the Confidentiality terms in theCustomer Terms of Service for more information.

4. How We Transfer Data We CollectInternationally

a. International Transfers withinCompass Global Services Inc.

To facilitate our global operations,we may transfer information to other Data4Sales Affiliates where we haveoperations for the purposes described in this policy.

This Privacy Policy will apply even ifwe transfer Personal Data to other countries. We have taken appropriatesafeguards to require that your Personal Data will remain protected wherever itis transferred. When we share Personal Data of individuals in the EuropeanEconomic Area ("EEA"), Switzerland or the United Kingdom("UK") within and among Data4Sales Affiliates, we make use of theStandard Contractual Clauses (which have been approved by the EuropeanCommission) as well as additional safeguards where appropriate (such ascommercial industry standard secure encryption methods to protect customer dataat rest and in transit, TLS for Data4Sales hosted sites, web applicationfirewall protection, and other appropriate contractual and organizationalmeasures).

b. International transfers to thirdparties

Some of the third parties described inthis Privacy Policy, which provide services to us under contract, are based inother countries that may not have equivalent privacy and data protection lawsto the country in which you reside. When we share Personal Data of individualsin the EEA, Switzerland or UK with third parties, we make use of a variety oflegal mechanisms to safeguard the transfer including the EuropeanCommission-approved standard contractual clauses, as well as additionalsafeguards where appropriate. For transfers to or from the United Kingdom, wemake use of the standard contractual clauses as adapted for the UK. Fortransfers to or from Canada, we make use of the standard contractual clauses.With respect to personal data received from or transferred to Canada,Data4Sales is subject to the regulatory enforcement powers of the Office of thePrivacy Commissioner of Canada. Please contact us if you need more informationabout the legal mechanisms we rely on to transfer personal data outside theEEA, Switzerland, Canada, and UK.

c. Privacy Shield Notice

Data4Sales complies with the EU-U.S.Privacy Shield Framework and the Swiss–U.S. Privacy Shield Framework(collectively, "Privacy Shield Frameworks") regarding the collection,use, and retention of Personal Data of individuals in the European Union,Switzerland and UK. Data4Sales is committed to subjecting all Personal Datareceived from European Union (EU) member countries, Switzerland and the UK inaccordance with the Privacy Shield Principles. Please note that we do not relyon the EU-U.S. Privacy Shield as a data transfer mechanism. To learn more aboutthe Privacy Shield Principles, visit the U.S. Department of Commerce's PrivacyShield List at https://www.privacyshield.gov.

Under certain conditions, more fullydescribed on the Privacy Shield website, you may be entitled to invoke bindingarbitration when other dispute resolution procedures have been exhausted.

5. How We Store and Secure YourInformation

a. Data Storage and Security

We use a variety of securitytechnologies and procedures to help protect your Personal Data fromunauthorized access, use or disclosure. We secure the Personal Data you provideon computer servers in a controlled, secure environment, protected fromunauthorized access, use or disclosure. All Personal Data is protected usingappropriate physical, technical and organizational measures.

b. Retention of Personal Data

How long we keep information wecollect about you depends on the type of information and how we collect andstore it. After a reasonable period of time, we will either delete or anonymizeyour information or, if this is not possible, then we will securely store yourinformation and isolate it from any further use until deletion is possible.

We retain Personal Data that youprovide to us where we have an ongoing legitimate business need to do so (forexample, as needed to comply with our legal obligations, resolve disputes andenforce our agreements).

When we have no ongoing legitimatebusiness need to process your Personal Data, we securely delete the informationor anonymize it or, if this is not possible, securely store your Personal Dataand isolate it from any further processing until deletion is possible. We willdelete this information at an earlier date if you so request, as described inthe section "How to Access & Control Your Personal Data" below.

If you have elected to receivemarketing communications from us, we retain information about your marketingpreferences for a reasonable period of time from the date you last expressedinterest in our content, products, or services, such as when you last opened ane-mail from us or ceased using your Data4Sales account. We retain informationderived from cookies and other tracking technologies for a reasonable period oftime from the date such information was created.

The data our customers process inconnection with the Subscription Service is retained according to Data4SalesCustomer Terms of Service.

6. Cookies and Similar Technologies

a. Cookies

When you visit our websites, sign upfor an Data4Sales account, attend an Aument virtual event, or request moreInformation about Data4Sales, we collect information automatically usingtracking technologies, like cookies and tracking pixels.

Data4Sales and our partners usecookies or similar technologies (such as web beacons and JavaScript) to analyzetrends, administer the website, monitor how visitors navigate around thewebsites, and to gather demographic information about our user base as a whole.

b. Advertising

We partner with third party adnetworks to display advertising on our website or to manage our advertising onother sites. Our ad network partner uses cookies and web beacons to collectinformation about your activities on this and other websites to provide youtargeted advertising based upon your interests.

c. Third Party Tracking Technologies

The use of cookies and web beacons byany tracking utility company is not covered by our Privacy Policy.

7. How to Access & Control YourPersonal Data

a. Reviewing, Correcting and RemovingYour Personal Data

You have the right to complain to adata protection authority about our collection and use of your Personal Data.

If you are a customer, prospect, orotherwise interact with an Data4Sales customer that uses our SubscriptionService and would like to access, correct, amend or delete your data controlledby the customer, please contact the relevant customer directly. Data4Sales actsas a processor for our customers and will work with our customers to fulfillthese requests when applicable.

b. Anti-Spam Policy

Our Acceptable Use Policy applies tous and to our customers and, among other things, prohibits use of theSubscription Service to send unsolicited commercial e-mail in violation ofapplicable laws, and requires the inclusion in every e-mail sent using theSubscription Service of an "opt-out" mechanism and other requiredInformation. We require all of our customers to agree to adhere to theAcceptable Use Policy at all times, and any violations of the Acceptable UsePolicy by a customer can result in immediate suspension or termination of theSubscription Service.

c. To Unsubscribe From OurCommunications

You may unsubscribe from our marketingcommunications by clicking on the "unsubscribe" link located on thebottom of our e-mails, updating your communication preferences.

d. To Unsubscribe From Our Customers'Communications

Our customers are solely responsiblefor their own marketing e-mails and other communications; we cannot unsubscribeyou from their communications. If you are a customer, prospect, or otherwiseinteract with an Data4Sales customer, you can unsubscribe from our customers'marketing communications by clicking on the "unsubscribe" linklocated on the bottom of their e-mails, or by contacting them directly.

8. California Privacy Rights

a. Applicability

This section applies only toCalifornia consumers. For purposes of this section "PersonalInformation" has the meaning given in the California Consumer Privacy Act("CCPA"). It describes how we collect, use, and share Californiaconsumers' Personal Information in our role as a business, and the rightsapplicable to such residents. The California Consumer Privacy Act("CCPA") requires businesses to disclose whether they sell PersonalInformation. Data4Sales is a business, and does not sell Personal Information.We may share Personal Information with third parties if those third parties areauthorized service providers or business partners who have agreed to ourcontractual limitations as to their retention, use, and disclosure of suchPersonal Information.

If you are unable to access thisPrivacy Policy due to a disability or any physical or mental impairment, pleasecontact us and we will arrange to supply you with the information you need inan alternative format that you can access.

b. How We Collect, Use, and Share yourPersonal Information

We have collected the followingstatutory categories of Personal Information in the past twelve (12) months:

– Identifiers, such as name, e-mailaddress, mailing address, and phone number. We collect this informationdirectly from you or from third party sources.

– Commercial Information, such assubscription records. We collect this information directly from you.

– Internet or network information,such as browsing and search history. We collect this information directly fromyour device.

– Geolocation data, such as IPaddress. We collect this information from your device.

– Financial Information, such asPayment Information or financial account numbers in the process of providingyou with a subscription. We collect this information from you.

– Inferences.

– Other Personal Information, ininstances when you interact with us online, by phone or mail in the context ofreceiving help through our help desks or other support channels; participationin customer surveys or contests; or in providing the Subscription Service.

The business and commercial purposesfor which we collect this information are described in Section 2 of thisPrivacy Policy. The categories of third parties to whom we "disclose"this information for a business purpose are described in Section 3 of thisPrivacy Policy.

c. Your California Rights

You have certain rights regarding thePersonal Information we collect or maintain about you. Please note these rightsare not absolute, and there may be cases when we decline your request aspermitted by law.

The right of access means that youhave the right to request that we disclose what Personal Information we havecollected, used and disclosed about you in the past 12 months.

The right of deletion means that youhave the right to request that we delete Personal Information collected ormaintained by us, subject to certain exceptions.

Data4Sales does not sell PersonalInformation to third parties (pursuant to California Civil Code §§1798.100–1798.199, also known as the California Consumer Privacy Act of 2018).

You can exercise your rights yourselfor you can alternatively designate an authorized agent to exercise these rightson your behalf. Please note that to protect your Personal Information, we willverify your identity by a method appropriate to the type of request you aremaking.
